Terms & Conditions HIRE
For the purposes of these Terms and Conditions, the individual or organisation hiring the trailer shall be referred to as “the Hirer”. All trailers remain the sole property of Holme Valley Trailers, hereafter referred to as “the Owner.”
Identification
The Hirer must provide valid identification prior to hire, consisting of:
A current photo driving licence, and
One original household bill dated within the last 12 weeks
The Hirer consents to copies of these documents being taken and retained by the Owner until the trailer has been returned.
Insurance & Towing
It is the Hirer’s responsibility to ensure that their vehicle insurance policy permits the towing of the hired trailer. Only the vehicle specified on the hire agreement, and driven by persons insured under that policy, may tow the trailer.
Payment & Deposit
Full payment of the hire fee is required at the time of collection, along with a refundable £100 deposit.
Ownership & Value
The trailer remains the property of the Owner at all times. The Hirer gains no ownership rights or interest beyond the right to hire the trailer for the agreed period.
The trailer’s value is stated on the hire agreement. The supplied hitch lock is valued at £150, which the Hirer acknowledges and accepts upon signing.
Risk & Liability
All risks transfer to the Hirer once the hire agreement has been signed and the trailer leaves the Owner’s possession.
The Owner accepts no responsibility for injury, loss, or damage to the Hirer, their agents, third parties, animals transported, or any consequential losses arising from the use of the trailer during the hire period.
The Hirer agrees to fully indemnify the Owner against any claims relating to injury or damage to persons or property connected with the use of the trailer.
Loss, Damage & Theft
The Hirer is fully responsible for the trailer throughout the hire period, whether attached to a vehicle or not. This includes liability for theft, damage, accidents, or loss.
Any animals or items transported or stored in the trailer are carried entirely at the Hirer’s risk.
If the trailer is stolen, lost, destroyed, seized, impounded, or not returned at the end of the hire period, the Hirer agrees to pay the full declared value of the trailer immediately. Daily hire charges will continue to accrue until payment is made, charged pro rata where applicable.
The Hirer is also responsible for the full cost of repairs or replacement parts resulting from damage or theft. All repairs must be carried out by an authorised Ifor Williams or Cheval agent.
Repairs & Maintenance
The Hirer must notify the Owner immediately if the trailer requires repair or adjustment and must not authorise any work without prior written consent.
Restrictions on Use
The trailer must not be:
Used for hire or reward
Used for illegal purposes
Used for purposes other than its intended design
Taken outside England, Wales, or Scotland
The trailer must not be lent, sold, sub-hired, or otherwise transferred to another party without the Owner’s consent.
Failure to Return
Any trailer not returned at the end of the agreed hire period will be reported to the police as stolen. The Hirer agrees that identification documents supplied may be shared with the police and recovery agents to assist in recovery.
The Hirer is liable for all legal, solicitor, and court costs incurred by the Owner in recovering the trailer, its value, repair costs, or any outstanding hire charges.
Daily hire charges will continue to apply for each day or part day the trailer remains unreturned. The Hirer also agrees to cover any recovery costs incurred after verbal or written requests for return.
Termination of Hire
The Owner reserves the right to terminate the hire agreement and request immediate return of the trailer if:
The terms and conditions are breached
The trailer is misused
Complaints are received from police or third parties
The trailer is exposed to unnecessary risk
In such cases, any refund due will be calculated on a pro rata basis, less any costs incurred by the Owner.
Equipment & Security
A spare wheel is provided. The Hirer is responsible for any tyre damage or replacement during the hire period.
A hitch lock is supplied and must be used at all times when the trailer is unattended. The Hirer must take all reasonable precautions to protect the trailer from theft or damage.
Vehicle Requirements
The towing vehicle must be fitted with:
A suitable tow bar
A 50mm tow ball
7-pin 12V electrical connection
Safe Use & Loading
The trailer is used entirely at the Hirer’s risk. Manufacturer weight limits and tolerances must not be exceeded.
The heaviest horse must always be loaded on the right-hand side. If transporting a single horse, it must be loaded on the right.
Condition & Cleaning
The Hirer must inspect the trailer on collection and confirm its condition. The trailer must be returned in the same clean condition, internally and externally. A £25 cleaning fee will apply if returned unclean.
Long-term hirers must regularly wash the trailer, including roof and side panels, to prevent staining or damage. Only water and approved cleaning agents should be used, as some chemicals may cause damage.
The Owner advises that all cleaning is undertaken safely and with appropriate equipment.
Car Trailer Hire (Only)
